When you purchase any product, using our services or creating a ticket from Kyhlus Services you automatically agree to the Terms of Service and Privacy Policy listed in this document posted in our discord and website or other social media.
1.0 - These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Kyhlus Services. ("Company", “we”, “us”, or “our”).
Kyhlus Services reserves the right to change and modify our Terms of Service and Privacy Policy at any time without client notification. It is up to the client to periodically check and familiarize themselves with any adjustments to our Terms of Service or Privacy Policy.
1.1 - We ask that all users/clients carefully read our Terms of Service and Privacy Policy (which can be located below). Kyhlus Services reserves the right to suspend, cancel or terminate any service provided without notice or reason for any given reason. If you disagree with our Terms of Service, Privacy Policy or any additional terms and conditions which are available via hyperlink then you may not access our discord, website or use any of our services.
2.0 - Unless otherwise indicated, the website and the products/services are our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, international copyright laws, and international conventions. The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Service, no part of the site or the products/services and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
Provided that you are eligible to use the website, you are granted a limited license to access and use the website and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the site, the Content and the Marks.
3.0 - All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the site. If you are a minor, you must have your parent or guardian read and agree to these Terms of Service prior to you purchasing and using the website, using our services or creating a ticket.
4.0 - You may be required to register with the website in order to access the products/services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
5.0 - You are not allowed to copy or claim any of Kyhlus Services team’s work as your own, nor copy any of our documents. However, if you want to sell or redistribute any of the products that you purchased, you must get explicit permission from the Freelancer that created that product/work. All products that have been redistributed/resold or copied will be claimed under Kyhlus Services property and legal actions may be taken.
6.0 - You agree to provide current, complete, and accurate purchase and account information for all purchases of any product or service made via the website or discord. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in U.S. dollars.

Any other payment alternative will not be accepted and Kyhlus Services is not responsible for any payment lost.
6.2 - If you need the freelancer to work directly in your hosting/machine we require a 100% upfront payment for live work.
6.3 - You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order. If your order is subject to recurring charges, then you consent to our charging your payment method on a recurring basis without requiring your prior approval for each recurring charge, until such time as you cancel the applicable order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.
All our tickets are required to receive 50% before any work is started. The final product will not be sent until you pay the other 50% in the invoice.
6.4 - Kyhlus Services requires a handling fee of 10% up to $900 U.S dollars and 7% for commissions above which is automatically generated and added to the invoice. You will receive the order invoice link on your ticket.
6.5 - All payments must go through paypal Goods and Services.
6.6 - You can not request a modification from your order, if you need modifications for the order you should pay extra (including handling fee) the new price is at the discretion of the freelancer.
6.7 - We reserve the right to refuse any order placed through the site. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.
7.0 - Kyhlus Services may give refunds in the following circumstances up to 75%. However, all sales are final and no refund will be issued (website), refunds via Discord are not guaranteed.
Some examples for circumstances where you can request a refund:
1. Order has not started.
2. Missed deadline (3% per day up to 75% refundable)
3. If you do not receive the product via our website.
Examples where you are not eligible for a refund:
1. If the delay is caused directly by you or by any third-parties or situations which are out of our control and restrict our capability to complete the commission.
2. If you decide to cancel the commission after the freelancer already starts working on it.
If the refund is approved, the payment will be sent without handling fees.
All refunds need to be revised and approved by our Executive Team.
7.1 - Any chargeback is not allowed and legal action will be taken. You will also be blocked from our website and discord as well as from any other site managed by Kyhlus Services.
8.0 - Kyhlus Services is not responsible for any actions of our freelancers or team members outside of Kyhlus Services website or discord or other social media.
8.1 - Kyhlus Services is not responsible for any corrupt files, loss of files or passwords, we advise you to keep backups.
8.2 - Kyhlus Services is not responsible for any damage caused by team members including our freelancers.
9.0 - There may be information on the site that contains typographical errors, inaccuracies, or omissions that may relate to the marketplace offerings, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the site at any time, without prior notice.
10.0 - The website and the products/services are provided on an as-is and as-available basis. you agree that your use of the site and our services will be at your sole risk. to the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the site and the marketplace offerings and your use thereof, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. we make no warranties or representations about the accuracy or completeness of the site’s content or the content of any websites linked to the site and we will assume no liability or responsibility for any (1) errors, mistakes, or inaccuracies of content and materials, (2) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the site, (3) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (4) any interruption or cessation of transmission to or from the site or the marketplace offerings, (5) any bugs, viruses, trojan horses, or the like which may be transmitted to or through the site by any third party, and/or (6) any errors or omissions in any content and materials or for any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available via the site. we do not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the site, any hyperlinked website, or any website or mobile application featured in any banner or other advertising, and we will not be a party to or in any way be responsible for monitoring any transaction between you and any third-party providers of products or services. as with the purchase of a product or service through any medium or in any environment, you should use your best judgment and exercise caution where appropriate.
